The Supreme Court has asked the Chief Justice of the Allahabad High Court to make Justice Prashant Kumar sit in the division bench with a senior judge. Even if it is necessary to sit in a single bench, do not let any criminal case listen. The Supreme Court has said so, expressing strong objection to the decision of Justice Prashant Kumar in one case.

The bench of Justice JB Pardiwala and R Mahadevan has said, “We have not seen a bad order from this as a judge in his tenure so far. The judge has made fun of justice. We are not able to understand how such a decrease can happen at the level to the High Court. Sometimes we have to think whether such orders are given in the absence of law or any external reason.”

HC was correct to make business dispute criminal suit
This resentment of the Supreme Court was about such a case, a business dispute was justified by the High Court to make a criminal case. In his order, the High Court judge wrote that the complainant is a small company. The civil lawsuit lasts for a long time. It will take a long time to get him money in this way.

On reading this decision on 5 May 2025, the Supreme Court canceled it without issuing notice. The judges expressed surprise, saying, “Do the High Court judges do not know that there is no recovery of money from the criminal case. For that, only a civil case has to be fought.”

The Supreme Court has sent the matter back to the High Court. The Chief Justice of the High Court has been asked to put it up to another judge for hearing. Also, Justice Prashant Kumar has been said that as long as he is in office, he should never be allowed to hear any criminal case.

Lalita was the case between Textile and Shikhar Chemicals
The case was about payment of 7 lakh 23 thousand rupees between Lalita Textile and Shikhar Chemicals. Lalita Textiles had called this amount outstanding, including interest, not getting 4 lakh 59 thousand rupees out of the supply of thread supplies in 2019. On the complaint of Lalita Textile, the ACJM court of Kanpur had filed a case under Section 406 (Criminal Business) of the IPC and issued summons to Kumkum Pandey, the mistress of Shikhar Chemicals.

Shikhar Textile had approached the High Court protesting against the registration of a criminal case in the civil case. But Justice Prashant Kumar of the High Court refused to cancel the case. Now after the order of the Supreme Court, there will be a fresh hearing in the High Court.
