The Supreme Court was hearing a petition challenging the order of the Madras High Court. It was said that Sri Lankan Tamil citizen should leave India as soon as the sentence of seven in the UAPA case is completed. The petitioner’s counsel told the bench that Sri Lankan Tamil youth had come here on a visa. He is in danger of life in his country. He has been in custody for three years without any exile process.

Justice Dipankar Dutta asked the lawyer that what is your right to settle here? So the lawyer said that the petitioner has settled in a refugee and his wife and children in India. On this, Justice Dutta said that there has been no violation of Article 21. His freedom was taken away. But according to Article 19, only Indian citizens have the fundamental right to settle in India. When the lawyer said that the petitioner is in danger of life in his country, Justice Dutta said that any other country should go.

The petitioner was arrested in 2015 on suspicion of being a LTTE worker along with two other people. He was convicted by the trial court under the UAPA and sentenced to 10 years. The Madras High Court had reduced his sentence to three years. The High Court had said that after completion of the sentence, he would have to leave the country. The lawyer said that the petitioner had fought in Sri Lanka as a former member of LTTE in 2009 and has been taken out from there. If he is sent back, his life will be in danger. He said that his wife and son are suffering from many diseases.
