The Supreme Court on Friday dismissed the FIR lodged by his wife against a person, citing the exception of marital rape. A bench of Justices Vikram Nath and Justice Prasanna B. Varale did not find a prima facie case against the appellant Kuldeep Singh.

The apex court accepted his appeal against the Punjab and Haryana High Court’s decision, refusing to dismiss the victim’s cousin on 14 June 2022. The Supreme Court said, during the investigation, it was established that the victim had married the appellant of her will. The court also said that the appellant has rightly stated that according to exception-2 under Section 375 of the IPC, a person’s sex with his wife cannot be called misdemeanor. Therefore, the court said that the allegations against the appellant under Section 376 cannot remain. The bench also found that in a reply filed by the victim on the petition to restore the marital rights of the appellant, it has not accused the appellant of marriage or forced marriage.

The appellant said that he and the woman had married each other on June 15, 2022 against the wishes of their relatives according to the Sikh customs and ceremonies. After marriage, in view of the protest by the victim’s family members, the married couple also filed a security petition before the High Court on June 16, 2022 to protect their lives and freedom. The High Court also provided security to the couple. The victim returned to her parents’ house on August 2022. The woman then changed the statement and accused the appellant of rape.
