The petitioners said that their fourth and fifth rank were ranked in the Judge Advocate General’s examination, despite the male officers with less rankings were appointed. The petition said that only six posts were released in the department, out of which there were only three vacancies for women. After the hearing, Justice Dutta asked Additional Solicitor General Aishwarya Bhati that ‘If women in the Indian Air Force can fly fighter aircraft Rafael, then why is it difficult to include more women in the posts of Army Judge Advocate General?’ Along with this, the bench directed the petitioner Arnsur Kaur to be included in the legal branch of the army. At the same time, another petitioner Aastha Tyagi has joined the Indian Navy. The apex court then questioned the Center that they have set low positions for women, while claiming that the posts are genderly neutral.
Aishwarya Bhati defended the Central Government’s decision, saying that ‘from 2012 to 2023, in the ratio of 70:30 (or now 50:50), it would not only be wrong to call the policy of recruitment of male and female officers to be discriminatory and fundamental rights, but will also be a violation of the jurisdiction of the executive, which is a violation of the jurisdiction of the executive, which is the only competent and only authority to decide the recruitment of male and female officers in the Indian Army.
