The Supreme Court has expressed strictness about misleading medical advertisements. The court directed the government to form a system to file a complaint against such advertisements. The court said that a system should be developed through which common citizens can file a complaint against misleading medical advertisements. The apex court also emphasized the importance of the Drug and Magical Treatment (Offensive Advertising) Act and said that its implementation is very important.

A bench of Justice Abhay S Oka and Justice Ujjal Bhuiyan heard the case and asked Senior Advocate Shadan Fraud (Nice Mitra) to present a note on the implementation of the Act till the next date. The Act controls the advertisement of drugs in India. It bans the advertisements of medicines and treatments that claim magical qualities and do so makes it a cognizable offense.

Justice Oka verbally told the arguments that the first mechanism would have to be established under the said Act. It is one of the most important acts. Keep your note on record. We will particularly pass comprehensive instructions. We will instruct to install the entire mechanism. Prosecution must be run. The grievance redressal system must be there. If a citizen wants to complain, how will he complain? We will instruct to make some dedicated phone line or something so that people can file a complaint. This work should have been done in advance.

Justice Oka also asked the court to inform the court on the provisions of the Act, the necessary compliance under it and whether the required mechanism to implement it in the states and union territories. On 7 May last year, the court directed the states and union territories to violate their licensed authorities to violate the Drugs and Magical Treatment (Offensive Advertising) Act, 1954, Drugs and Cosmetics Act, 1940 and Consumer Protection Act, 2019 File an affidavit regarding the action taken from 2018 in relation to misleading advertisements. It was also said that they should also clarify their inaction in imposing punishment and preventive measures for compliance with laws.
