Senior Advocate and Rajya Sabha MP Kapil Sibal have reacted to the statement of Vice President Jagdeep Dhankhar. He said that the President is a Titular head and the post of governor is also like this. The Constitution has given the power of Article 142 to the Supreme Court. He said that he was sad to hear the statement of the Vice President and also surprise, he should not talk like a party’s spokesperson but talk fairly. Kapil Sibal also says that when the people of the government do not like the judiciary, they attack, when you like it, they say to the party that the court’s decision is.
The Vice President has objected to the decision of the Supreme Court in the Tamil Nadu Government vs. Governor case, which said, ‘The Governor cannot hang the bills passed from the assembly for a long time. Decision to give approval, stop or send a bill to the President will have to be taken inside the deadline, he can send a bill to the government again for consideration. If the Legislative Assembly passes the bill back in the old form, then the Governor has no option but to approve it.
The Vice President strongly criticized the court’s decision and said that there was never such a democracy in India, where the judge should work as a law maker, executive or super parliament. He said that we cannot create a situation where the courts should direct the President.
‘I am saddened by the Vice President’s statement’, Sibal said
Kapil Sibal said on this that he respects the Vice President, but he should not say so. He said, ‘The power of Article 142 gives the Constitution to the Supreme Court. The President is a tissue head. The post of governor is also like this. Governor cannot stop the bill, send to the President. If the President works with the advice and cooperation of the cabinet, then there is no question of questioning the right of the President.
Kapil Sibal said, ‘There are such statements attack on the rights of the judiciary. Can the President stop the pass bill from Parliament for infinite time? How will such work do? The Supreme Court has a decision of 2 judges or 5 judges, everyone has to obey. The Chairman sits between the opposition and the opposition in the House, they are fair. Can not work like a party spokesperson.
‘Power Constitution of Article 142 gave the Supreme Court’, Sibal said
Kapil Sibal also said on the Vice President’s statement that if he has a problem with any decision, he can review, which is the way or can also seek advice from the Supreme Court under Article 143, it is also a way. Jagdeep Dhankhar had said that Article 142 has become a nuclear missile against democratic forces, on which Kapil Sibal said that the missile was demonetisation, which the government had run on the people. Do not call the court’s decision a missile.
Article 142 empowers the Supreme Court to give any order, instruction or decision to do full justice, whether it is in any case. Kapil Sibal said that the judge cannot answer, you are trying to teach them a lesson by making such statements. He said that Veeraswami is a decision that the Chief Justice will decide, do you not believe it.

Kapil Sibal also raised the case of a cash heap recovered from the Delhi High Court judge’s house and questioned why the FIR did not happen in this case. He said that if the executive does not do its work, then the judiciary will intervene. Sibal also referred to Allahabad HC Judge Justice Shekhar Kumar Yadav and said that he did not demand the FIR, then you did not demand communal things.
