District Judge William Alsup, USA’s San Francisco, ordered the Personnel Management Office (OPM) to inform some federal agencies that he had no right to order the dismissal of personnel working on probation including the Defense Department. He said, “OPM has no right to hire or remove any other employee other than himself under any law.” Alsup last week gave this order under temporary relief sought by labor unions and non-profit organizations in the case filed by the organization.

Five labor unions and non-profit organizations sought relief from the court

The complaint filed by five labor unions and five non-profit organizations is one of the several cases that push back the administration’s efforts to reduce the federal workforce, which Trump has called a more working and careless. Thousands of probationary employees have already been fired and their administration is now targeting career officers with civil service safety.

The litigants say that the Personnel Management Office has no right to terminate the job of probationary employees, which are usually on the job for less than a year. He also says that he was fired on the basis of lies of poor performance of employees.

Government lawyers said- we did not order dismissal

Government lawyers say that the Personnel Management Office did not instruct the dismissal, rather asked the agencies to review and determine whether the employees on the probation are suitable for further jobs. They also say that the probationary employees are not guaranteed jobs and only the highest performance and mission-mating employees should be hired.

Federal agencies have around 200,000 probationary employees- generally employees who are on jobs for less than a year. The complaint states that around 15,000 employees are employed in California, which provide services ranging from fire to legends. The unions have recently argued with two other federal judges in similar cases, which tried to stop the target of the Trump administration to make a federal workforce.

Democrat Alsup, appointed by President Bill Clinton, has presided over several high-profile cases and is known for his impeccable words. He oversee the criminal probation of Pacific Gas and Electric and called the country’s biggest utility “constant threat to California”.
