The Gujarat High Court heard the petition filed for not getting promotion to the CRPF personnel. The court said that the Central Reserve Police Force (CRPF) did not promote a high position to a female worker due to HIV-AIDS infected. This is clearly discriminated against the employee. The court has summoned the CRPF Law Officer.

A division bench of Chief Justice Sunita Aggarwal and Justice Pranab Trivedi on Wednesday heard the petition filed by the women personnel of CRPF. The female worker said that despite completing other eligibility criteria, she is not being promoted as she is infected with HIV-AIDS. The court directed that the matter be brought to the notice of Additional Solicitor General in charge of India. The bench said that the law officer should be presented on the next hearing. The next hearing in the case will be held on March 6.

During the hearing, the lawyer appearing on behalf of CRPF argued that a permanent order was passed as per the rule. It states that the candidate should be fit for promotion. On this, the court said that the case offers a clear example of discrimination against personnel suffering from a disease called HIV-AIDS in the Central Reserve Police Force.

The petitioner’s counsel argued that the female personnel are constantly being denied promotion, while he is eligible for promotion from all other aspects, except the fact that he is suffering from infectious disease.
