The parliamentary committee examining the bill to remove the Prime Minister and Chief Ministers (130th Constitutional Amendment Bill 2025) on Wednesday (December 17) asked for evidence-based reasons for the proposed law, and asked if there were any precedents for such laws anywhere in the world. In fact, under this bill, Prime Ministers, Chief Ministers and ministers who are in custody for more than 30 days on corruption or serious criminal charges will have to leave their posts on the 31st day. On August 20, 2025, Home Minister Amit Shah introduced this bill in the Lok Sabha.
Three bills discussed in joint committee meeting
The Constitution (130th Amendment) Bill, the Jammu and Kashmir Reorganization (Amendment) Bill and the Government of Union Territories (Amendment) Bill were discussed in the joint committee meeting chaired by BJP MP Aparajita Sarangi. It was also decided in the meeting that the committee would consult constitutional experts, retired judges, lawyers and bar association members.
Sarangi said there was consensus in the meeting on the need to end criminalization of politics. He told the media after the meeting, “Two things were specifically discussed in today’s (Wednesday) meeting. Honorable MPs sought evidence-based clarification for the bills and wanted to know whether such laws exist in any country.”
Meeting with Home Ministry representatives on January 7
Sarangi said representatives of the Ministry of Home Affairs (MHA) are expected to give their reply in the next meeting, which will be held on January 7. Sources said the MPs asked 25 questions and the Home Ministry will answer in the next meeting. Sources said the Home Ministry sought suggestions from members on ways to bring sanctity in the country’s political system and prevent people holding public positions from indulging in corruption.

However, some MPs raised questions as to how a law could be made to remove an MLA or MP elected by the people. Several opposition parties stayed away from the committee, arguing that these bills violate the basic principle of law that someone is presumed innocent until proven guilty and that the Prime Minister, Chief Ministers and ministers will be automatically dismissed if they fail to obtain bail within a month of their arrest in serious criminal cases.

NCP-SP leader Supriya Sule, All India Majlis-e-Ittehadul Muslimeen MP Asaduddin Owaisi and YSRCP’s S Niranjan Reddy are the only opposition members in the 31-member panel dominated by the BJP and its alliance partners.
